Since 1988 Italy has had a new Code of criminal procedure, which marks a clear departure from inquisitorial civil law tradition and a decisive move towards the adversarial model typical of common law jurisdictions. The 1988 Code is based on the principle of parties' confrontation, according to which only the evidence produced in a public trial, which grants cross-examination, may be used as a basis for the judge’s decision. This stands in opposition to the inquisitorial system, where the decision is grounded upon the records of the evidence gathered unilaterally and in secret during the preliminary investigation by the magistrate in charge.
